I have read the entire court transcript my parents had sent to them. This is the most outrageous verdict I have ever seen. First of all, not only was my parent's attorney, Tim Biasello magnificent, he is like part of our family. He was just as devastated as we were about this completely disgusting verdict. I read all the testimony from every witness. Tim exposed all of Benson's various stories and lies through witness testimony, but sometimes, when listening to all those questions, you can become confused as to what he may be trying to get. That is why there are closing arguments. I can only say Tim's closing argument was incredible. He put everything together so perfectly, I was able to get a very clear picture of every discrepancy and lie that there was. Sitting there listening to him, you would have to be not even human to see it. Remember too, this was a civil case, they only had to decide on a preponderence of the evidence. It's "more probably true than not". They didn't have to decide beyond a resonable doubt. This case was proven way beyond even a preponderence. This man had so many different stories about when it was that he drew his gun, that he changed it yet again 4 days before the trial to "I had my gun out when I heard he may have a gun, then I reholstered it so I could opereate my spotlight,and drew it again when he ran at me." Something to that effect, I don't have the exact words in front of me. He had to say that because he had two other stories in his interview and his deposition, so he had to explain that and bridge the stories together. Like Tim said in his closing arguments, this man knew what he was going to do, he had no intention of using anything other than his gun. Which is true, he knew as soon as he got there what he was going to do. Thats why he radioed 40 seconds after arriving "subject has gun". Nobody ever said that, and none of the witnesses heard it either. That story changed as well, to he said he heard someone say he "may" have a gun. Of course it did, because he knew nobody ever said it, that he was making it up, and nobody would ever find a gun that Nick had, so he had to say "may". Why did he wave the paramedic away as Nick lay on the ground, with Benson's gun still pointed at him, after he was shot twice? Every single thing this so called deputy said was crap. Tim's words: He played fast and loose with his testimony.
I don't care what anybody thinks, that I'm biased or whatever, or that we should accept this and move on. My parents don't care how long it takes, if it takes until they die, we will get justice for Nick. I don't care if it takes until I die, we will get justice for Nick. Nick deserves that and so do we.
