I read all the PDF files on the site, the transcripts, etc. I ordered Nicholas' book, too. I have nothing but sympathy for your family. I have a few questions.

1. Are audio recordings of the dispatch calls and 911 calls available? If so, those should be posted as well. They are very confusing to read; hearing them might shed light or might make it even more confusing.

2. What other evidence did the judge exclude, besides the person who had been stopped 21 times?

3. Where was Nicholas living?

4. Is this "cop" still a cop with the same assignment/job? Does he still patrol the Frazier Park?

5. It would seem from the evidence that the cop made a terrible, horrible mistake, and was perhaps trigger-happy. I can see why the corrupt, blue-line cops would want to protect their own. I can see why the county would want to protect itself from lawsuits by covering up. (I can see, not that I agree with this!) But with a clean tox report, what could possibly keep the county/police from finding those who committed the assault? This would not "harm" them (the cops or the county) in any way. If they were trying to perpetuate a lie that finding these other criminals would deny... but this just doesn't make any sense.

It seems to me that there are three possibilities, given the known facts (there was an assault, he was NOT on PCP). Which is most likely?

A. The cop was presented with a situation that was confusing and many other cops would have responded in the same way, however tragic and error-riddled that decision would have been.

B. The cop was a tragically bad cop, who made a terrible judgement call, misinterpreting the situation grossly.

C. The cop was trigger happy and felt like shooting someone, and at this moment he felt he had enough "plausable denyability" to go for it.

Just such a sad, sad case. I look forward to receiving the book and reading it.
