That is a strong healthy background and is critical in the validation process of patent litigation.
If you invent a new and useful technology product but cannot prove after the us patent is allowed that you have sufficient background knowledge in the art which your invention is claimed to superceed. Technically it would be possible for someone like Rossi to start a patent infringement suit even if he had no cause or justification for it. With focardi et al you would lose unless in the beginning we came diversified in skills that would lead a legal representative to believe it was a dead end street.
That glitch without being disclosed prior to project involvement is not as strong as defense in the validation process of the patent issued.
